The group of professional and novice musicians, cultural associations (Musicarte, Rock Action Sur, Local Akople, House of Blues) owners of local small and medium capacity and the public concurrent with the rest of the undersigned, music fans live, exposes a serious problem affecting the city of El Puerto de Santa Maria: More and more frequent intervention by the authorities to suspend local concerts small and medium capacity, without being clear and transparent criteria for conducting these restrictions, and without contemplating any legal option to seek permission for such regular rooms. The situation of radical uncertainty violates the principles of legal certainty and interdiction of arbitrariness of public powers enshrined in art. 9.3 of our Constitution. The radical restriction of the concerts of recent times seems to lead to a patently absurd conclusion: low any way you can program any type of live music in bars. This reality has serious social, economic and cultural. We understand that musical activities must have adequate technical conditions to ensure public safety and convenience and to avoid noise pollution and nuisance to neighbors. We assume that may be necessary to put limitations on the intensity of the volume of music or concert schedules. But do not think it reasonable to prevent radically any musical activity. What we ask is possible, which is shown because there are precedents. Recently, the city council has incorporated into its municipal ordinance the category "Music bar with live music, featuring local bar and live music played or has no dance floor or comparable space (amendment BOP published ordinance No. 60 of 03.10.2008, p. 58). To express our discomfort with this situation and to require the competent authorities to take action on the matter and try to find a reasonable solution to the problem , presented and signed this letter as a tool for citizen participation.
